FORT WORTH FAILURE TO IDENTIFY LAWYER

FORT WORTH FAILURE TO IDENTIFY LAWYER

A Track Record of Successful Results in Complex Cases

In the great state of Texas, if you are detained or arrested by law enforcement, you are required to provide your name, date of birth, and residential address. This enables police officials to quickly learn if they are dealing with an individual who has a significant criminal history. If you refuse to provide the requested information, you could be charged with failure to identify.

If you have been arrested and charged for failure to identify in Fort Worth, the Law Office of A. Oliver Hassibi can help. I can examine the facts surrounding your case and aggressively challenge the initial grounds on which the officer detained or arrested you. If there is a way to get your charges reduced or dismissed, you can rely on me to find it.

Failure to Identify Laws in Fort Worth

There are two different types of situations that can lead to failure to identify charges in Texas, including:

  • Refusing to provide personal identification information to an arresting officer upon request
  • Providing false or fictitious identification information to the arresting officer

Those who refuse to provide the requested information can be charged with a Class C misdemeanor. This is the least serious of all misdemeanor charges, having no jail time and a maximum penalty of $500. If the individual was a fugitive from justice at the time the crime was committed, the charge will be elevated to a Class B misdemeanor. The consequences for this type of charge can consist of up to 180 days in jail and a maximum fine of $2,000.

When the failure to identify violation involves falsified information, it is charged as a Class B misdemeanor. Anyone who is a fugitive when the offense takes place will be charged with a Class A misdemeanor. The penalties for this charge increase to a maximum jail sentence of one year and a fine of up to $4,000.
