As defined in Section 30.05 of the Texas Penal Code, criminal trespass is the act of entering onto someone else’s land unlawfully or without consent. What’s more, it is illegal to enter and stay on someone else’s property if you have been given notice that entry into the property was forbidden or if you received notice that you should leave the premises and then subsequently failed to comply with the property owner’s notice.
As described in Texas Penal Code § 30.05, criminal trespass is a Class B misdemeanor. However, you could be charged with a Class C misdemeanor if the offense is committed on agricultural land within 100 feet of the land’s boundary or on residential land within 100 feet of a protected freshwater area. The offense becomes a Class A misdemeanor if the offense is committed in a habitation or shelter center, Superfund site or critical infrastructure facility, or if the offender was carrying a deadly weapon.
Under law, you may be exempt from punishment if it can be established that you were a firefighter or emergency medical services personnel participating in official duties; an employee or agent of an electric utility, telecommunications provider, gas utility, or municipally owned utility who was acting within the scope of your employment; or someone who was employed by an entity that had consent to enter the property.
